ANNEX XXI. MODEL OF THE CLAUSE FOR THE GENERAL CONDITIONS OF CIBETRANS S.A.

PRIVACY AND DATA PROTECTION POLICY

In compliance with the provisions set forth in Organic Law 15/1999, of 13 December, on Personal Data Protection, CIBETRANS S.A. informs its customers of the following points:


EXISTENCE OF A FILE

The personal data that customers provide to us, freely and voluntarily through the forms enabled by the company for such purpose, will be included in a CUSTOMER database that is owned by and the responsibility of CIBETRANS S.A., with its registered address at C/ Frederic Mompou Nº 4, Escalera A, 5º 1ª, 08960 Sant Just Desvern, Barcelona (Spain). Said database is registered in the General Data Protection Registry of the Spanish Data Protection Agency.The acceptance of these General Conditions means that customers give their consent to the fact that said personal data will be the object of automated processing in order to comply with the contracted service.

PURPOSE OF THE FILE

The purpose of the collection and automated processing of the personal data by CIBETRANS S.A. is to manage, administer, provide, expand and improve the services offered by the company.

USER’S RIGHTS

In the event that users deem it appropriate to exercise the rights to which they are entitled, specifically the rights of access, rectification, cancellation and objection to the processing of their data, they can contact the processing manager at the following electronic address: This e-mail address is being protected from spambots. ASSIGNMENT OF DATA

The personal data provided may be assigned by CIBETRANS S.A. to the companies whose work and cooperation may be strictly necessary for complying with the jobs contracted by the company and whose involvement in the development of the commercial relationship is implicit in the services provided by CIBETRANS S.A.

The use of these data is only assigned in order to complete these tasks, and it is thus recorded in the documentation whereby we are related to such companies. These assignee companies are expressly prohibited from using this data in any way other than that which is imposed for carrying out the contracted job.

Moreover, within the framework of the tasks to be performed by CIBETRANS S.A., and as the object of one of the specific tasks to be developed with International Transport Companies, Airlines, Shipping companies, Cargo Terminals and all other third parties of this type, invoices of expenses that are provided on behalf of our customers are issued under the concept of services not directly contracted by CIBETRANS S.A. but which it has to cover in the development of the job as the necessary designated intermediary unrelated to the company’s will. The data learned in the exercise of these tasks will not be processed or stored, nor will they be assigned to any unrelated company, and CIBETRANS S.A. is relieved of any liability that could be generated from the unauthorised use of the same by all other operators.

SECURITY MEASURES

CIBETRANS S.A. guarantees the security and confidentiality of the data provided. In application of the provisions set forth in the Regulation on Security Measures of Computer Files that contain personal data (Royal Decree 994/1999), the company has adopted the personal data protection security levels that are suited to the quality of the data provided by customers, thereby endeavouring to install all technical protection means and measures within its reach to prevent the alteration, loss or unauthorised processing or use thereof.

MODIFICATION

CIBETRANS S.A. hereby reserves the right to modify this Privacy Policy in order to adapt it to new legislation or laws, as well as the practices of the sector. In such events, CIBETRANS S.A. will announce the changes introduced at its web page, www.cibetrans.com , and in the General conditions, reasonably in advance of being put into effect.
